DMCA & Intellectual Property Policy

Always Festive (alwaysfestive.store) respects the intellectual property rights of others and expects our users and suppliers to do the same. We respond to clear notices of alleged copyright or trademark infringement consistent with the U.S. Digital Millennium Copyright Act (DMCA).

Reporting Infringement

If you believe content or a product listing on our site infringes your copyright or trademark, send a written notice to our designated agent at legal@alwaysfestive.store including:

  • Your physical or electronic signature;
  • Identification of the work or mark claimed to be infringed;
  • Identification of the material claimed to be infringing and its URL on our site;
  • Your contact information (name, address, email, phone);
  • A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law;
  • A statement, under penalty of perjury, that the information is accurate and you are the owner or authorized to act on the owner’s behalf.

Our Response

Upon receiving a valid notice, we will remove or disable access to the material in question and, where appropriate, notify the supplier or party who posted it. We may remove listings proactively where we identify a credible IP concern.

Counter-Notice

If you believe your material was removed in error, you may submit a counter-notice to legal@alwaysfestive.store with your signature, identification of the removed material and its prior location, a statement under penalty of perjury that the removal was a mistake or misidentification, and your consent to jurisdiction as required by the DMCA.

Repeat Infringers

We may remove listings and terminate the accounts or supplier relationships of repeat infringers.
