Always Festive Terms of Service

These Terms of Service (“Terms”) govern your use of alwaysfestive.store and related services (the “Services”) operated by Always Festive (“we”, “us”, “our”). By using the Services or placing an order, you agree to these Terms and our Privacy Policy. These Terms include a binding arbitration agreement and a class-action waiver (Section 12) that affect your legal rights. If you do not agree, do not use the Services.

1. Eligibility & Accounts

You represent that you are at least the age of majority in your jurisdiction, or are using the Services with the involvement of a parent or guardian. You are responsible for the accuracy of information you provide and for activity under any account you create.

2. Products & Availability

We strive to represent products accurately, but colors, sizes, and appearance may vary by screen and production batch. Descriptions, pricing, and availability may change without notice, and we may limit or discontinue products.

3. Orders

Placing an order is an offer to purchase. We may accept or decline any order, and orders are not accepted until payment is processed and confirmed. Returns and exchanges are governed by our Refund & Return Policy. Purchases are for personal use, not resale.

4. Pricing & Billing

Prices are subject to change; the price at checkout applies. You represent that your payment information is valid and authorized. Prices exclude taxes, shipping, and duties unless stated.

5. Shipping, Title & Risk

All shipping times are estimates, not guarantees. Title and risk of loss pass to you when the carrier receives the order. See our Shipping Policy.

6. Third-Party Suppliers & Fulfillment

Some products are fulfilled by third-party supply and fulfillment partners, including overseas warehouses. We remain your point of contact for support, but delivery timing depends in part on these partners and carriers.

7. Intellectual Property

All site content—text, images, graphics, trademarks, and layouts—is owned by Always Festive or its licensors and protected by law. You may use the Services for personal, non-commercial purposes only and may not reproduce or exploit content without our written permission. See our DMCA & IP Policy.

8. Product Safety

You agree to follow all product labels and instructions and our Product Safety & Prop 65 notice. Products are for ordinary consumer use; we are not liable for misuse.

9. Prohibited Uses

You may not use the Services for unlawful, fraudulent, infringing, abusive, or malicious activity, for scraping or data harvesting, or to disrupt or bypass security. We may suspend or terminate access for violations.

10. Disclaimer of Warranties

Except where expressly stated and to the fullest extent permitted by law, the Services and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Always Festive and its affiliates, employees, and partners are not liable for indirect, incidental, special, punitive, or consequential damages, or loss of data, profits, or revenue. Where liability cannot be excluded, our total liability is limited to the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some may not apply to you.

12. Binding Arbitration & Class-Action Waiver

Please read this section carefully. Except where prohibited by law, any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in or near Williamsburg, Virginia, rather than in court—except that either party may bring qualifying claims in small-claims court. You and Always Festive waive any right to a jury trial and to participate in a class, collective, or representative action. You may opt out of this arbitration agreement by emailing legal@alwaysfestive.store within 30 days of first accepting these Terms.

13. Indemnification

You agree to indemnify and hold harmless Always Festive and its affiliates from claims, damages, and expenses arising from your use of the Services or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law rules. Subject to Section 12, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Virginia.

15. Changes; Severability; Entire Agreement

We may update these Terms by posting changes here; continued use constitutes acceptance. If any provision is unenforceable, the remainder stays in effect. These Terms and the policies referenced are the entire agreement between you and Always Festive.
